I have the chance to walk several properties that the landowners say no one has permission to hunt....every property has had multiple tree stands on them and a few had cameras over corn piles. Explain to me why this happens so much in Iowa?
 
The reason Im asking is because where I came from in SE Ohio this didnt seem to happen to the degree it does here...

Because some landowners don't want to deal with it. Trespassing is not their list of priorities.

Yeah they actually helped me take down the stands and cameras.....the one treestand was permanent built with all treated lumber and pole barn spiked into the tree
 
Just like folks talking about poaching "where they hunt - it's bad"... Every person I talk to, no matter where in the state, has poachers. Same with trespassers. If you don't have trespassers & poachers in your area- you are the exception. That's messed up. Need to tighten down penalties & like I've said... As much as I respect the DNR - I sure wish they put more focus on the aggregious poachers. I'd be totally fine with my CO spending all his "deer time" with a Robo-buck for couple years instead of checking licenses & ticketing/spending time on "minor offenses".
Too bad you have to deal with those sorts of trespass issues & hope you solve it!
 
I have already put word out it will not be tolarated for any reason. All landowners have a lot invested in their property and should not be infringed upon.

I totally agree, lots of problems in Michigan with the same thing. But, as for CO's as much as deer are important there are all kinds of species and seasons they must focus on as well. Plus, it's usually not the CO's fault that people get a slap on the wrist for violations. The courts have alot more to do with it, judges and prosecutors who are more focused on the "real" crime and don't care about the silly animal laws. Alot of judges here in Michigan refuse to enforce the mandatory jail times for some game violations. People know this and therefore to the poacher/trespasser it's worth the risk of getting caught, especially since the chance of getting caught is so low as there are so few CO's in the field. It's a flawed system but it's what we have to work with for the time being. Hopefully the more that we the hunters speak up the more the rest will realize we want these issues taken more seriously!

Yes, this is what happens in most cases but even if you do go after them they are issued a $65 fine that is usually thrown out of court anyway. $65 is a lot cheaper than a lease and with the money some antlers can fetch on the market it is not enough to deter anybody.

Ignoring trespassers could be a very serious liability issue. If one of the trespassers is injured, do not for a minute think he will not sue the landowner (even though he did not have official permission to hunt).

As an insurance agent, I have seen the claims. One guy received $100,000 when he fell out of a tree stand. In that case he had permission, but still sued his friend.

If someone is on a property frequently they could easily argue in court that the landowner was aware of their presence.
 
Remember most lawyers are after blood and if they get involved you can get papered to death. 1000 paper cuts kills just like a knife, I know.

I will have insurance like the hunting lease network offers that I think? but I could be wrong even cover acts of trespassers and litigation. Trust me you dont want lawyers involved cause you lose no matter what.
 
It happens so much because our public lands are very crowded. Not saying having more public land would fix the problem, but we also need stiffer fines on hunters that trespass.

Yeah Ohio has an amazing amount of public land and its no different, I just notice more bow hunters tresspassing here

Its because they can get away with it, all they would have to do to is drag it across the fence and noone would know that they shot one!

I am optimist at heart & want perfection for a state I love, even though I know it'll never happen! :way::grin:

Iowa has laws that protect a narrow group that you give permission to hunt. Doesn't include a host of other things. The good news is: high dollar insurance is not that expensive & you are a tard if you don't get it!!!! I shopped around & found a really good carrier for liability insurance for my farms if anyone wants to save a little time- PM me. Not bad at all & you are insane if you don't get insurance.

As far as a lawsuit against the landowners... most states have a recreational use act which protects the landowner from such liability issues - we have it here in SD and I have never heard of someone trying to sue a landowner.
