Thanks for the input fellas.. i think im just going to let it play out for now and see what happens next season as far as how the deer react to it. I would rather not have a dispute but he just keeps pushing.. ive got some tricks up my sleeve though 
if he really wants to be an ass, im going to make him put about 200 ft of fence between his and my yard to keep his damn dog from crapping infront of my front doorstep and ill let him keep dropping $20+ per panel and thousands of feet of galvanized piping and then ill nicely let him know that a lawful fence may not exceed 54"..
