I heard about a cow elk being shot opening weekend around the Minden Iowa area. The story I heard was a group of hunters encountered a bunch of does and began firing at them. Apparently they hit 5 of the "deer" but when they got over to them, one was a cow elk. They called the DNR and an officer arrived and confiscated the animal but did NOT ticket the shooter.

Now, does anyone know; if the elk was a fugitive from a county park, would they not be ticketed for harvesting an animal that is protected in Iowa? Or would you only be ticketed if it was considered a WILD animal?

Botna Bend park is roughly 15 miles from Minden in Hancock, Ia and they have a nice herd of elk and buffalo. I haven't heard if Botna Bend has lost any recently, and usually that kind of news travels quickly.
 
I don't know about that area or the ticketing procedure, but I do know that I was blown away when I read this post. You have to be a serious no talent pu$$y to mistake a elk for a whitetail. It never fails to amaze me how F'n stupid some people are, and I hope that tool gets fined. Just another example of not verifying your target before you pull the trigger. WOW is all I can say. Scary to think these people walk around with guns.

Couldn't have said it much better myself. Can't wait for the negative press this will get. Sounds like these guys need to learn how to not "flock shoot".

Maybe it was not a mistake, unlikely I know. Actually there is nothing yet confirming it even happened. Hasn't the DNR wanted all escaped elk killed for fear of CWD and other disease? Maybe that's the reason for confiscation?

There was an incident in Iowa last year with some elk, and the DNR did not want any hunters to shoot them, but the DNR shot them with a rifle.
 
I shot a Werewolf last week by my house here in Urbandale but when I recovered it, it had changed back into my neighbor's dog. (D.S.) (and kidding on that one- I didn't really shoot anything :) ) Yeah folks, as time goes on and folks realize that most guys out there really don't know what they are doing, you'll understand how this crap happens all the time. Sorry- out during gun season, MOST the guys I see have no clue - not saying all are dangerous BUT rather they just don't know what they are doing. Like the 20-ish year old kid that put a slug in the tree right above my head as he was shooting at a squirrel on his deer drive 2 years ago (yes, I was in ORANGE, waving and screaming at him!!!) or the clowns whizzing bullets past my head shooting at deer in the field (on a place I had permission on) out their car window. Problem is: I probably could list out 20-30 experiences off top of my head with idiots that have no clue what they are doing. Why I spend vast majority of my time bow hunting or if I'm gun hunting- making sure I avoid everyone else and hunt by myself. crazy!!!

Same excuse idiots use when they shoot a 200 lb 4.5 year old Doe...uh er I mean shed buck during late rifle season.
 
My buddy and I were hunting southwest Iowa last year and I was filming him when he said here comes an elk. I think I asked him 3 or four times "what" before I looked over and seen a nice 5x5 bull elk making his way toward us. I got on the phone with dnr to see if it was legal to take. I got a no for answer and we had to watch him walk by at 20 yards. The muzzleloader would have filled the freezer for sure. Got a good few minutes of great video too. He sure didn't seem real tame acted just like a wild elk.
 
Page 18 of the hunting regs say's Elk are protected in Iowa and a $2500.00 liquidated damage fine will be charged if you do shoot one. It say's nothing about if it has an ear tag in it or not. I guess I wouldn't shoot.
