crp question

So the trust behind my house is all in crp. I get along with the owners even if I am not a fan of the way they do things. They have been reasonably agreeable as far as most of our contact. A few spats but nothing I really care about. My issue is the one brother feels he can do what he wants when he wants, acts very entitled. He has, the past two years mowed large chunks of the grass filled with boxelder trees this time of year, basically clear cutting. I am not sure this is ok? It's his land, but its nesting and fawning time. I didn't think that it was allowed. Dont really like to get involved and its in clear view of the road.... not really sure what to do bit I was wondering from someone who has experience what the deal is thought it was may 15. I think it's been in since the early 2000's.

In MN you cannot now from June 1-Aug 1 because of nesting season. I'm not even sure if you can mow after May 15 without permission.

Iowa, I'm not sure might be different?
 
You can't mow after the 15th, but maybe he can because he got permission. It's been so wet this last week in places.

Your neighbor was a couple days late, give him a break. You can clear cut it if you want, but only with permission. You can even bale it and everything with permission from what I understand.
 
We have been very dry until the last few days. I am not fired up to do anything really. I am more curious. I do have a feeling that he will keep at it as he is just getting started.
 
If it's really bothering you, ask at the county USDA/FSA office? They make (& sometimes enforce) the rules and approve the exemptions.
 
If it is CRP he shouldn't be mowing now unless he got permission due to thistles or other noxious weeds. The other side to it is Crp shouldn't have volunteer trees so he is doing the right thing just at the wrong time of year. The nesting season in south central Iowa is May 15 to August 1. It may be different in your area.
I would probably let it go if it was one of my neighbors.

I was thinking the same. He needs to maintain it he just always does it this time of year. He lives up in Minnesota so he isn't around much the time of year he should do it. It's more his attitude, he is a bit pompous and arrogant. But we get along enough and I provide him easement. For now I think I will but out, if he does it three years in a row I doubt it's more than he doesn't care. I don't really have time to chase around finding out at this point. I would be inclined to ask him to his face if it comes to it.
 
Everything depends on your contract. It will require one mid plan management action of either burning, discing, mowing, overseeding or spraying if I remember correctly. This must be done once between years 3-7 unless you have another written plan approved. I was thinking activity must cease from April 1st through August 1st.

I'd personally call in and ask the question about his specific farm. There's no harm in that. If he's following the rules great but if not then he deserves what he gets. No one in their right mind would be in mowing right now that cared about wildlife.
 
Yeah the weather has been fine, and he has a lot left to do so I am sure being around just in weekends he will be moving a month from now. I have a feeling he is doing whatever he wants. He is always trying to get then county to do stuff to benefit him and blames them for run off and flooding issues. Never his fault.
