So, I was out mzloader hunting with my buddy and after he shot a Buck I desided to walk around awhile. I spotted 3 Does on our property and I look up above me and I see this...

It's about 65 yards from the fence line on our property. There's some sort of white thing on the tree on the other side of the fence I'm thinking it's a attractent of some type. Right by the stand there's a dead 'Yote on our side of the fence that's been dead for 1-2 days and my hunting buddy said he didn't see it when he went hunting right there opening day. Should I take it? Or make a attempt at trying to find out whos it is? Or just sit in it every day during Mzloader and then Bow next year and wait for him to come? xD

EDIT: They also cut down about 10 trees and a lot of branchs.

If it were mine I'd be owning a new stand. If they came and asked for it back, I'd probably give them a lecture about who's land they were hunting and depending on how they acted I would probably give them the stand and make sure they know not to come back.
 
If it is truly "your" property and you are 110% sure no one else is allowed to hunt there for any reason in any season, I would take it down. Leave a note pinned to the tree in a plastic bag to protect from weather stating "I have your stand, it is on my property and you are trespassing, please call xxx-xxx-xxxx to explain why are hunting here and why you should get your stand back." Probably never hear a word back from anyone.
 
The only problem is, if I shoot a Deer and have to bring a gun onto their property (if it's the neighbors) then I don't want bad relations.

This is what I would do as well. Maybe they have a reasonable explanation as to why they were there....if this is your property. If not, then get the owners involved.

I would call the neighbors first and see if it is their stand then. Maybe they have someone hunting on them that decided to fence jump onto you. Either way, they are not respecting your property. Unless you and the neighbors have some sort of agreement that you can both hunt on both sides of the fence like that.

If its not their stand, then take it down and leave a note with your name, # on it so whomever it is can call. Better yet, leave the Game Wardens # if he/she will allow that and they can explain it to them...after you notify the Warden first of course.
 
A friendly conversation with "the neighbor" would be a good way to start. If that doesn't take care of the problem there are many other not-so-nice ways to take care of this situation
