Because the pheasant is in the Ditch key word ditch!!! That is public the property of the owner is not what you are hunting it is the ditch. Different types of land, your coworkers are absolute morons!!

Pretty much. Thankfully the issue has not come up again as it got a little heated last time we talked. Their stance at our last conversation was "if it isn't legal, how can you hunt pheasants in a ditch"? We agreed to disagree and left it at that.

Tell them to hunt a ditch you should have permission from the private landowner if you are planning on shooting the bird OVER private property. Also tell them that the landowner OWNS and pays taxes to the center of the road. The ditch and road is simply an easement which unfortunately does allow them to trap and hunt (with certain restrictions) but does NOT give them legal right to shoot game over or ON private property.
