Attacking a DNR Officer - Winneshiek County

Your scenerio doesn't even make sense. Do you know what entrapment is? I didn't feel like reading this entire post so I dont know if they were on his land or not. If they were and they were trying to "set him up" than i'd say that is entrapment. I'd say serves them right. You can only take people coming onto your land and shooting deer for so long. If word gets out that you beat the crap out of someone I garauntee that people will think twice about stepping onto your land. I agree that taking a stick to them is alittle harsh, but the guy was out numbered what do you expect. He also should have stoped when they said they were COs and asked them what they were doing. Truth is. it's the heat of the moment and you just do what you have to do.

Maybe it would be a good idea to actually read everything before forming an opinuon that you put in writting. If you had read everything you would know that the officers were responding to a call about trespassing and hunter harrassment, not sneeking in undercover to "entrap" this poor missunderstood man who then jumped a fence and attacked them with a limb. Your remark about the heat of the moment is exactly what would get you jailed under interferance with offical acts laws. Futher your remarks about beating the crap out of someone is assault in any court, and using a stick because he was outnumbered just isn't very smart especially when people were carrying guns.
We all need to get as much information before replying to some of these kind of posts. Remember first engage brain then engauge mouth, or as here fingers.
 
I wouldn't go jumping to any conclusions based on the article from the Decorah paper. There seemed to be alot of holes in it. We should let the facts come out in court.
At least then we will know once and for all whether this poor fellow was just another tragic case of entrapment by the DNR.
 
I'm curious what it matters if it is entrapment?

What is it when the DNR sticks a dandy 180" buck in a fenceline just off the gravel road at night so Johnny poacher can take a whack at him.......entrapment????

I was being a smarta-- in my post. Simply wearing an orange vest and wearing clothes that a deer hunter would wear is in no way entrapment.

In Texas yes.

Courts have ruled that it is illegal to use Record Sized Antlers to entice illegal poaching.
 
I have to agree with a comment bowmaker made about never talking to someone who thought a CO was pleasant when giving him a ticket. I have been checked three times and each time i ended up shooting the !@#$ with them about everything from ducks to deer. I think they are just as interested in what's going on on the water or in the timber b/c they don't get to enjoy it like we do. Here's a thought, should we quit sending narcotics officers out on the streets to "deal drugs" b/c of the poor drug dealers that get caught due to unfair entrapment? The CO's have a tough job and I commend them for what they do b/c I work as little as possible from Oct to Jan.

The bottom line is anyone who wasn't there can Monday morning quarterback this one to death. All branches of law enforcement have a tough job - by choice, granted - but tough nonetheless. The subject who decided to take a tree branch and use it as a weapon needs to take some responsibility for his actions, assuming the officers - no matter how they were dressed - identified themselves properly. This is in no way entrapment.

Longspur, no offense, but just I love your post, it starts with "The bottom line is anyone who wasn't there can Monday morning quarterback this one to death." and ends with the (Monday morning quarterbacking) statement "This is in no way entrapment.".

Does anyone else see the irony or is it just me?

I can't think of any scenario where jumping a fence and attacking two people regardless of the circumstances, besides self defense, is justified. From reading the facts the two CO's were walking when attacked. Let me add that verbal confrontation is absolutely not a justified reason to physically attack another.
Hoytmossy, the only result in confrontation is injury and possibly death, nobody's property, or deer, is worth a human life. Recall the scenario last yeat in Wisconsin??? A confrontation over trespassing that resulted in a mulitple shooting.
That said, I will err on the side of law enforcement and bet this guy is prosecuted.
