Rural Elgin Man Charged in Hunter Harassment Incidents

Brian Gibson, 44, of rural Elgin, has been charged two counts of hunter harassment, one count of reckless use of a firearm, and two counts of assault with use or display of a dangerous weapon.

Gibson is alleged to have harassed a bow hunter on Nov. 6, by intentionally shooting a rifle in the direction of the hunter's deer stand while the hunter was in it, and later verbally abused the hunter. The hunter was on land not owned by Gibson.

Then on Nov. 11, Gibson is alleged to have approached the same hunter while the hunter was on land where he had permission, and fired shots in the area, intentionally spat tobacco juice around the hunter's deer stand, turned his dog loose in the area, and urinated near the deer stand while the hunter occupied the stand.

The reports were investigated by the Fayette County Sheriff's Office and the DNR State Game Warden assigned to Fayette County, along with consultation from the Office of the Fayette County Attorney.

Gibson is set to appear in person or by legal counsel in Iowa District Court in Fayette County on December 14, 2009 to answer the charges. All persons are presumed innocent until such time as a court of law determines otherwise.
 
There is nothing tough about firing a rifle in the direction of someone in a tree stand. In situations like this I recall a forest gump saying, "stupid is as stupid does". Hope the law is not easy on this guy, these are the type of people who give gun owners a bad name.
 
I hope they really put the screws to this guy. He not only makes all gun owners look bad but intentionally firing in the direction of the hunter could have had deadly results. Stick it to this guy.
 
I hope that guy gets thrown in jail. More than likely if found guilty he'll pay a fine and restitution. They need to take his guns from him for that crap.
 
I was harassed by a lady a couple of years ago. It was a neighbor and out of fear of the crazy lady doing something in response that may harm/hurt my family I quit hunting the area. Wasn't worth the potential harm to my property and my loved ones.

After the incedents I did come across the Colorado state law that covers this issue. Not much of a fine is incurred but there is potential of a hunting liscense supension. If you are interested the law is copied below.

[FONT=Arial, sans-serif]Hunting, trapping and fishing – intentional interference with lawful activities. [/FONT]
[FONT=Arial, sans-serif]1. No person shall willfully prevent or interfere with the lawful participation of any individual in the activity of hunting, trapping, and fishing in accordance with this article. 2. A person commits intentional interference with lawful hunting, trapping, and fishing activities if he: a. Acts with intent to alarm, distract, or frighten prey and causes prey to flee by: I. Use of any natural or artificial source of noise or light; II. Giving chase to prey on foot or by use of any vehicle; III. Throwing objects or making movements; b. Intentionally harasses any person lawfully participating in the activity of hunting, trapping, and fishing by use of threats or actions; c. Erects barriers with the intent to deny ingress to lawfully designated hunting, trapping, or fishing areas; d. Intentionally interjects himself into the line of fire; e. Engages in any other conduct with the intent to disrupt or prevent lawful hunting, trapping, and fishing activities. 3. Any person who violates this section is guilty of a class 2 petty offense and, upon conviction thereof, shall be punished by a fine of not less than one hundred dollars nor more than five hundred dollars and an assessment of twenty license suspension points. 4. Any person convicted of a violation of this section shall be liable for all damages incurred by the individual whose lawful activity was obstructed and for all court costs of prosecution. 5. Nothing in this section shall limit the actions of law enforcement officers and personnel of the Division of Wildlife in the performance of their official duties nor apply to landowners, tenants, or leaseholders exercising their legal rights to the enjoyment of land, including, but not limited to farming, ranching, and restricting trespass, nor will anything in this section be construed to prohibit any incidental interference arising from the lawful use of land or water.
