Hypothetical Question?

Alright I have a question to see what everyone's thoughts are. This pertains to bowhunting only (unless you are south of HWY 30 and shotgun hunting). Let's say you are driving down the road, you have your bow in the vehicle with you and you spot a deer working its way across a field and it's OBVIOUS that it is going to cross a road soon. You have time to park (behind a hill maybe) get your bow and sneak down the ditch to where you are anticipating the deer to cross. Once that deer hits the ditch, it's fair game. Would you do this????

Given the right circumstances, I would. I would not if the ditch I was to be "hiding" in was next to a busy road, don't need to give the wrong impression to some people. And honestly, it would look a little shady if someone was in a ditch with bow in hand waiting for a deer to jump the fence.

Now I anticipate hearing a few people say something to the extent of this not hunting and it's kind of a cheap way to take a deer. I agree, to a point. What if the deer in question were making its way towards a timber across a pasture or field that you had permission to hunt and you had time to get ahead of it in order to intercept it? Would you do this? and would it be a cheap way to take a deer? Same concept, just different situation.

Just thought it might produce some interesting thoughts.

For those of you that are wondering what my reference to "North of highway 30" is, in Iowa, you can NOT shoot a firearm from the ditch NORTH of HWY 30. This is straight from the regs:
You cannot shoot any rifle on or over any of the public highways or waters of the state or any railroad right-of-way. You cannot discharge a shotgun
shooting a slug, pistol or revolver on or over a public roadway.
Additionally, no person shall discharge a rifle, including a muzzleloading rifle or musket, or a handgun from a highway; or discharge a shotgun shooting slugs
from a highway north of U.S. Highway 30, while deer hunting.
“Roadway” means the portion of the highway
improved, designed or ordinarily used for vehicular
travel, including the shoulder.
“Highway” means the entire width between
property lines
 
IMO the only way I would consider doing this is if I had permission to hunt the adjoining property. If the person didn't have permission it would be to risky. Chances of you dropping the deer in the ditch and him not making onto the private land is slim. With that said, assuming you have permission, I see nothing wrong with trying to take advantage of a opportunity. Some of the biggest bucks in the world were or have been taken in some unorthodox ways. Right place, right time analogy. I always have my bow with me during season, because you never know what may happen.
 
Your really going down this road lol. A few weeks ago me and a few others on here got in to a big heated discussion about the same thing. Most people on here think its not hunting and all that Crap, but like you said taking advantage of the situation is up to you. I would do it either way even if I didn't own any of the land around because you have the right to go on to some ones property to retrieve downed game with out your weapons. It's just like shooting a pheasant in the ditch. Just as long as your not shooting off or over the road you are fine.

Read further. "Highway" means the entire width between property lines. Fence to fence. The DNR describes the paved portion as "roadway"
 
If it's within the lines of the law, I don't feel right saying somebody is wrong or "cheap" in doing it. I don't see anything wrong in doing it and if the situation was right, I would probably do it myself. But, it all boils down to what YOU want to do, or feel is "ethical." If opportunity knocks, why not answer the door just because it knocked on the side door instead of the front door as you had planned?
 
Asking for trouble. You can't shoot over the fence and you can't shoot over the road. Your shot has to be right down the fence line and roadway. Sounds foolish to me as I think about it.
 
On most of my farms I actually own to the center of the gravel road as the legal description - but the county has right of way for the road.
I wouldn't take lightly to people hunting out of my ditch nor would most landowners I know.
I'm guessing most people that answered that it is perfectly fine to hunt from the ditch don't own land or their attitude would be different.

I don't own land of my own, but grew up in a farming family and am pretty protective over my families land and areas we hunt. And I do agree that it would not make me terribly happy to see someone shoot a deer in the ditch that just came from our land. But what's the difference between the deer jumping the fence and getting shot in a ditch and a deer jumping the fence and getting shot on the neighboring private or public land by someone sitting on the opposite side? I completely understand what you are saying, just playing devils advocate.

I don't own the neighbors land or the public land across the fence nor do I mow it, maintain it, pick up trash on it, etc. If you shoot a big buck there I will be happy for you and congratulate you.

On the road ditch along my property I do own it and maintain it.

BIG difference!

no different that a pheasant hunter hunting the ditch. kind of a nice loophole for the government. you own to the middle of the road, but yet the road ditch is public land
