I didn't know....

..that you had to report falling out of a tree stand. I knew that you were supposed to report gun shot accidents and the local hospital would automatically do it when you sought treatment. Now I guess they will be on the look out for ER cases involving falls from a tree stand. Not sure I understand the reason for this new law. My only guess is for statistics?

HUNTING ACCIDENTS. Amends Section 481A.18. Makes it a simple misdemeanor to fail to report an accident involving a gun or a tree stand.

I scratched my shin on a screw in step once. Does that mean I am in trouble for not reporting it?

I'm not sure what all goes into the report, but let’s say you need to list the make and model of the tree stand that may have been at fault. What better way to get the company to stop making death traps than to back it up with good information. Same thing goes for safety harnesses, climbing sticks, pegs, what ever. It is a good way to keep track and eliminate crap products.

There is an association out there that certifies tree stands as meeting some sort of safety standards. I'm not sure if all manufacturers are compelled to meet these standards or not.

Not that I want Big Brother to tell me what to do, but if the statistics show that a certain type of stand or harness are killing people the State should have the right to try and protect their hunters from crappy products.

The other thing that bothers me some is the potential for laws requiring that harnesses be worn by anybody hunting from an elevated position if it can be proven that X number of lives could be saved or injuries prevented by using a safety harness. I won't go in a tree with out one, but I don't think it should be a law. Kinda like motorcycle riders and helmets, you shouldn't ride your cycle with out one, but I support your right to do so and it keeps me in business when you don't.

Wow, didn't know that one. Does that mean falling out and hanging from your harness or falling 20 feet to the ground? I experienced my first hanger last year while hanging stands, hope I never have to again.

Thank-you insurance lobbyists.

Now there will be more question when acquiring health insurance:

Question 234a: Do you actively participate in outdoor activities which would require the use of a tree-stand?

Question 234b: If you answered yes to question 234a, how many hours per year would you estimate you spend in a tree-stand?

Question 234c: Are your tree-stands TMA certified? If not, why?

Question 234d: Have you ever had an accident (fall, or otherwise) while engaging in the use of a tree-stand?

etc. etc.

Watch your premiums go up!!!

That is absolutly the down side and who do you think would push any legislation requiering the use of safety devices?

I sometimes think our elected officials are just minions of the insurance lobby and their risk mittigation managers.
