Criminal charges filed for Cass County hunting violations against six Shelby Countians

ATLANTIC - As a result of an investigation by the Iowa Department of Natural Resources and with the cooperation of the Iowa State Patrol, five individuals from Harlan and one from Elk Horn have been charged with numerous Iowa DNR hunting violations and other related criminal offenses that are alleged to have occurred on or about November 24, 2006 in Cass County.

Of those charged Aaron D. Holtz and Bradley E. Wendt are officers of the Harlan Police Department and Kent A. Gries is an officer with the Coon Rapids Police Department.

According to Daniel L. Feistner, Cass County Attorney those individuals and charges filed include:

(1) Pursuing Deer with a Motor Vehicle, a Simple Misdemeanor in violation of Iowa Code Section 481A.38
(2) Trespass, a Simple Misdemeanor in violation of Iowa Code Section 716.7 (3) Trespass, a Simple Misdemeanor in violation of Iowa Code Section 716.7

Daniel J- Grabill, Harlan, Iowa
(1) Pursuing Deer with a Motor Vehicle, a Simple Misdemeanor in violation of Iowa Code Section 481A.38

Nothing in there states that they poached.

They were just pursueing deer with motor vehicles. Hmmmmmmm

And Trespassing

You would think they would know better beens they are part of law enforcement though

Heres an update taken from a local harlan news website.

One of the two Harlan Police Officers who was fired Monday came to the Harlan City Council meeting last night asking for an explanation. Officer Brad Wendt, who's been on the force for about 4 years, says he showed up for work on Monday and was told that he had a choice to either resign or be fired -- but he says he was never told why. Wendt asked why at last night's Council meeting. The only answer given was from City Administrator Terry Cox, who said employment is "at-will," and the working relationship has ended. And, Cox says that, according to state law, that's all that can be said about the decision.





The name of the other officer fired has not been released.

Wendt and officer Aaron Holtz were charged with hunting violations in both Cass and Adair Counties late last year. The charges stem from alleged incidents that happened in late November in which Wendt and Holtz, along with 4 other area men, were charged with violations such as trespassing, shooting from the roadway, and pursuing a deer with a motor vehicle. Wendt and Holtz have not been convicted of the charges. The case in Cass County is scheduled to be heard March 29th.
 
i have a bit of second hand knowledge on this case. i know one of the guys who filed a complaint against them.

this "infraction" occurred during the november antlerless season. there were tons of shots around this guy's house, and when he looks outside, wendt is out driving in his field, so he calls the law. when the DNR stopped them, (multiple trucks) there was atleast one dead buck. i believe all guns were confiscated, until they could determine who shot the buck. i've heard this wendt has a big reputation for trespassing, shooting from the truck, poaching, etc. i was also told, that after charges were filed, a couple of the officers charged went around to some of the landowners that they had tresspassed on, and tried to "convince" them to sign a paper stating that they actually had permission to be on their land. that, my friends, is tampering with a witness, and may be a federal crime. more charges may be pending
 
Teeroy - I wonder what kind of truck they were driving? One of my friends was bird hunting South of that area this fall and had a white truck crest the hill and they were shooting at a bunch of does (late November). My buddy, his wife, and sister had to literally hit the deck. I remember these Harlan guys being caught shortly after my friend told me what happened to him. If it's not these guys then someone else is out there doing about the same thing.
