You gotta be kidding! Aren't the liquidated damages for a deer more than $100 per animal in Iowa? Seems pretty lenient if you ask me.

I might have to swing out to talk with Mr. Kelly about hunting his ground. He might be more receptive now. Either that or he'll just keep quiet the next time he does it.

Guess I was wrong, it was pretty much an in and out case.
 
He was fined $100 on each count, plus court costs and a $1,500 civil assessment for the value of the deer.
 
The radio made it sound like it was only one deer but I thought he openly admitted to killing alot more than that?

He admitted he killed more but when he called the officer June 2, 2005, he only had one dead deer for the CO to photograph him with, thus he only got cited for one.
 
Some think we are back in Pioneer days, when you staked a claim on some land and defended it. Things have changed. There are alot of us now. Everyones actions affect someone else. Heck,,your land is not yours. Just stop paying your taxes and see whose it is. For better or worse, we can't go back to when the Pilgrims landed.
 
Don't kid yourselves, for Mr. Kelly this is a long way from over. He is already talking about finding ways to prove a defense of necessity. He is still out to prove his point and spend taxpayer money on stupid court cases.
 
I've talked to so many people that only know what they heard on the news and say "oh the poor guy". I tell them a few more of the facts in the story and most of them say "he deserves everything he got and then some"

Make sure people know ALL the facts and most will be against him.
 
I will stick up for him. There are to many deer and he is just trying to protect his farm. This is his only income. Dont get me wrong maybe he should build an 8 foot fence and keep them out. That would be a better plan.
 
I don't feel too much sympathy for him. In his catalog he sells a deer repellent that he guarantees will keep deer from eating your trees ... I'm not sure why he doesn't use the product he sells ...

This is a direct quote from an article published in Wallace's Farmer:
"Grower Kevin Kelly says it’s possible to fence his two tree farms, but realistically a deer fence wouldn’t work and is quite costly. He has 5 acres
in Christmas trees on one farm; the other farm has about 20 acres of trees including a nursery. A deer fence would cost $39 per foot. Kelly currently spends about $5 a year to solve his deer problem. “When you put up a deer fence to keep out the deer, you also keep out the predators,” says Kelly. “Then you are overrun with rabbits. Rabbits eat trees, too. Predators such as coyotes and other animals keep the rabbit population down.” The reason deer are so destructive in spring is because deer love to eat the new growth. “It’s their favorite food,” says Kelly. “One deer can eat the leaves off of 4 acres of small trees, with the leaves continually eaten off. The trees starve to death because leaves are what feed the tree by photosynthesis. We have some
damage in winter, too, but most of it is in the spring.”

Wow. I don't know where he's looking for deer fencing. I've never seen it that high. I can get it in the low $20's if I look hard enough.

Archery hunters would be a great asset for this gentleman, he just doesn't seem to care how he gets things done. He's not really trying to control the deer population, he's more worried about making a statement.
 
Can't think that this is good for his business. What are the alternatives?
This publicity that isn't good-
"Look kids, we are going to go get our Xmas tree at the place that shoots deer and leaves them to rot" vs A small sign that notes hunting is allowed to properly manage the local deer herd and comments like- "Oh honey, isn't it nice that bowhunters harvest animals here to donate to the food pantry"
