Two hunters have permission to hunt private land. Hunter #1 builds a permanent stand. The stand has stood for about 6 years, but was severely damaged during a storm last fall and needed major repairs. Before hunter #1 can repair the stand, hunter #2 does. Is it now his stand? It was so damaged (one of the supporting limbs was blown down) that he pretty much built a new one, although hunter #1s twenty foot wooden ladder is still being used to access the stand. The tree is a huge cottonwood, so removing the ladder will restrict hunter #1s access as well. Also can hunter #1 make an improvement on a flaw in #2’s design if it’s not #1’s stand anymore?

Hunter #1 is aware that hunter #2 has used the stand over the years. Both hunters usually hunt different seasons so it hasn’t been much of an issue, but if the question were to come up, who gets to claim the stand?

Well if ya get right down to it it is the land owners!! Being on someones land and building a fixed stand!! Well the ladder not being fixed is hunter no 1s HA HA got to love the the law HA HA

Well, yes I guess it would technicly be the landowners. And yes hunter #1 had permission to build the stand.

In my opinion, hunter ethics should've prevented #2 from moving in on a known location of #1.

I AGREE,HUNTER 2 SHOULD HAVE ASKED HUNTER 1 IF HE WAS DONE HUNTING THAT STAND.
 
I'd say you need to contact hunter #2 and see what intentions he/she have for the stand, you say they/he/she know it was your stand, maybe they just made improvements for you and them. If you hunt different seasons shouldn't be a problem. Give 'em a call, if you need to kick some a$$ over it i'll send someone over

well i myself would have to say that i myself would go by the rule in our deer camp: "if you built the stand then you have the say on who sits in it, and you can make your stand off limits to anyone in camp if you want, whether you hunt your stand or not" in our camp we don't touch or fix anyones stand unless granted permission by the person who built it! i hope this helps you out kat.

I would definatly say that this stand belongs to hunter #1. If he is not hunting it and gives hunter #2 permission than so be it. But as far as ownership of the stand hunter #1 owns it in my opinion.
 
To me it's not an issue of who's stand is it physically, but who's location is it. Otherwise another guy could put a stand in the same tree!
The only way #2 could aquire the location and any remaining material left by #1 is if #1 abandoned the site. That the issue in my mind. I would feel offended if another hunter placed a stand within gun range on any of my stands.
If #1 knowingly allowed #2 to hunt out of the stand he envited trouble. pick your spot and I'll pick mine!

If you hunting in Minnesota on public ground in northern minnesota, then the stand belongs to whomever is sitting in it, NO MATTER WHO built it.

Been their, done that. I dont know how many times I walked to my stand opening morning to find someone else in it. Guess thats why I dont hunt up their anymore.

I would say leave the permanent stand to rot, go throw up a portable somewhere else and hunt

my rule of thumb is, if you find a stand on a property that the person has permission to be one, stay at least 200 yards away from him / her and you should not have any problems. plus I could never hunt out of a permanent stand

I am with Liv4rut to some degree. Permenant stands are dangerous and really should not be used by anyone unless it is your own ground and you put it up. Too much liability for the landowner. With the amount you spend in wood, time and materials, you could get a sturdy aluminum stand that is TMA approved.

Just to answer the question tho, I would say #2 should contact #1 and tell him is stand is crap and say he will fix it (with a real stand) but also gains rights to hunt it.
 
I also think hunter #1 should be shown some courtesy by hunter #2. Although both are guest of the land owner, #1 clearly has been on this spot longer. Is hunter #2 a complete butt or just short sighted? I guess I would have to talk to him to get an idea as to his thought process.

I would never put any time or effort into a permant stand that could be viewed as community property. Shredders comment on switching to a portable aluminum really sounds like a winner to me. Nobody ever knows where you’re spending all of your quality time and they can figure things out for themselves. You can also hunt fresh stand locations a lot easier.
 
Get in an arguement, upset the landowner, he sells the ground & an new owners put up no trespassing signs. Neither have to worry about it.
 
i can settle this easily. its mine. tell me where it is, and i'll tear the sucker down and put it up in a better spot...and i won't tell anybody about it

Thanks for the great replies everyone. They were pretty much what I thought too, but wasn’t sure if I was right. Ironwood, hunter #2 is both a butt and shortsighted. Calling him might cause more problems. He also only hunts a few days out of the year, so it’s probably nothing to kick any a$$ over. (Thanks for the offer though, petrblt.)

Hubby is a sweetie, but he's not a hunter so he doesn't always get how we can be with our gear and stuff. I do have two other stands set up, so if I couldn't hunt that stand, I would not be 'standless.' (Is that a word??)
