Two hunters have permission to hunt private land. Hunter #1 builds a permanent stand. The stand has stood for about 6 years, but was severely damaged during a storm last fall and needed major repairs. Before hunter #1 can repair the stand, hunter #2 does. Is it now his stand? It was so damaged (one of the supporting limbs was blown down) that he pretty much built a new one, although hunter #1s twenty foot wooden ladder is still being used to access the stand. The tree is a huge cottonwood, so removing the ladder will restrict hunter #1s access as well. Also can hunter #1 make an improvement on a flaw in #2’s design if it’s not #1’s stand anymore?
Hunter #1 is aware that hunter #2 has used the stand over the years. Both hunters usually hunt different seasons so it hasn’t been much of an issue, but if the question were to come up, who gets to claim the stand?
